Dear Applicant,

The following information concerns the processing of your personal data (Art. 4 No. 2 GDPR) in connection with your application via our online application platform (https://www.einzigartigwir.de/en/job-offers/). Section I contains general information on the processing of your personal data and your rights and entitlements under data protection law. Section II (Special Information) concerns what data is processed and how it is used.

I. General Information

1. Who is responsible for data processing and whom can I contact?
   The party responsible for processing your personal data is:

2. What data do we process and where do we get it from?
   We process personal data that you provide as part of the application process. This data comes from either the online application form you complete or the files you upload (e.g. cover letter, passport photo, CV, certificates etc.) or the application documents you sent to us via email or post. By registering on our applicant portal, you provide us with your personal data with respect to a specific job application. Furthermore, when you use the online portal and visit our website, technical usage data is processed. Further details on the categories of data processed and where it comes from can be found in the Special Information section (point 1).
3. For what purposes do we process your data and on what legal basis?
   We process your personal data for various purposes in accordance with the General Data Protection Regulations (GDPR), the State Data Protection Act (LDSG BW) and the Federal Data Protection Act (BDSG). The following purposes apply: processing for the initiation of contractual relationships (Art. 6 para. 1 lit. b GDPR) and the protection of legitimate interests (Art. 6 para. 1 lit. f GDPR); and processing based on your consent (Art. 6 para. 1 lit. a) GDPR). For further details on the purposes of data processing, please refer to the Special Information section.
4. Who gains access to my data?
   Within the Central Institute, only those departments involved in the application process will gain access to your data. These are the HR department, the department in which the role is to be filled, line managers and senior managers, the staff council, and diversity and equality officers. Service providers employed by us and acting on our behalf (contracted processors, cf. Art. 28 GDPR) may also process data for these purposes.
   Details of the contracted processors we use and the people who gain access to your personal data can be found in the Special Information section (point 3).
5. For how long will my data be stored?
   As far as is necessary, we will process and store your personal data for the duration of the application process. If an employment/training/internship relationship is established, your data will continue to be stored and will be transferred to your HR file. Otherwise, the application process ends when you receive a rejection. The data will be deleted within four months of receipt of the rejection. This does not apply if the processing and storage of your personal data is necessary in a specific case for the assertion, exercise of or defence against legal claims for the duration of the matter in question.
   If applicable, you may, despite being rejected for the role you have applied for, be invited to join the talent pool for future vacancies at the Central Institute. Your data would then be retained for a maximum of one year.
   When your data is deleted, you will not be notified.
   You can access your electronic data at any time and amend or delete it, but doing so may affect the application process.
6. Will my data be transferred to a non-EU country or to an international organisation?
   Your data will be stored exclusively in a computer centre in Germany.
   Data processing by us takes place exclusively in Germany.
   Data processing by contracted processors currently takes place in a member state of the European Union, in another EEA state, Switzerland, the US or India. The last two states are countries with lower data protection standards than the European Union. For processing in these countries carried out by subcontractors, our contracted processors ensure appropriate levels of protection by putting in place standard data protection clauses (Art. 46 (2) (c) and (d) GDPR) or other contractual arrangements.</strongwill>
7. What data protection rights do I have?
   Every data subject has the right to information (Art. 15 GDPR), correction (Art. 16), deletion (Art. 17) restriction of processing (Art. 18 GDPR) and data portability (Art. 20). To exercise these rights, you can contact the offices listed under 'Who is responsible for data processing and whom can I contact?'
   Insofar as the processing of your personal data is carried out to safeguard our legitimate interests as per Art. 6 (1) (f) GDPR, you may object to this processing under Art. 21 GDPR.
   Further information on your right to object can be found at the end of this notice under 'Information on your right to object under Art. 21 GDPR'.
   If you believe that the processing of your personal data is unlawful, you also have the right to lodge a complaint with the data protection supervisory authorities (Art. 77 GDPR). 8. Am I under an obligation to provide data?
   There is no legal or contractual obligation for you to provide data. In the context of your application, you should only provide the personal data required for the application. Without this data, your application cannot be processed.
9. Data protection and confidentiality
   The Central Institute and the contracted processor have put administrative and technical measures in place to ensure your application remains confidential. Under the terms of their employment or other contract, all staff in the HR department, the persons responsible for recruitment and the contracted processor are obliged to maintain confidentiality of personal data. This obligation is based on general standards of data security in accordance with the current state of the art.

II. Special Information

This section concerns the processing of your personal data for job application purposes. The processing described below relates to applicants.

1. What data do we process and where do we get it from?
   Further to Section I (point 2), we process the following data or categories of data for online application purposes:

      • Hobbies and voluntary work
      • Former/current employment, e.g. duties, performance data, positions held (this data may be derived from your cover letter/CV/references)
      • Passport photo
      • Other data that you voluntarily provide to us in the application process via upload, cover letter, CV or references
      • Usage data:
        • For all visitors to the website, including those who do not complete the application process, the following data is processed: IP address, website accessed and date and time of access
        • Data that additionally accrues during the online application process: session ID
      • Communication data: details of face-to-face or telephone conversations and other data that arises during communication with you (e.g. in the event of telephone queries by us or when you use the contact form)

3. Who will gain access to my data?

   1. Contracted processors
      The online application portal is operated by an external data processor who collects personal data. Your data is stored and processed on the online application portal. The data will not be made available to employees of the data processor or passed on to other companies or persons outside the Central Institute or used for other purposes.
      The operator of the online applicant portal is Haufe Service Center GmbH, Munzinger Straße 9, 79111 Freiburg. The Central Institute has concluded an data processing contract with this company. This contract also includes subcontractual processors commissioned by Haufe Service Center. The commissioning of these subcontractual processors is based on agreements in accordance with Article 28 (2-4) GDPR.

   2. Data controllers
      Your data will not be disclosed to third parties for independent processing, except to the aforementioned data processor and, where applicable, its subcontractual processors.

4. To what extent will I be subjected to automated decision-making?
   ur decision-making in the application process is not based on automated processing as per Art. 22 GDPR.

5. To what extent will my data be used for profiling?
   Your data will not be used for profiling. Profiling is any type of automated processing of personal data that consists of using such data to analyse or predict certain personal characteristics.

Your right to object under Art. 21 GDPR

You have the right to object at any time, on grounds relating to your particular situation, to any processing of your personal data that is carried out on the basis of Art. 6(1)(f) GDPR (processing of data on the basis of a balance of interests). This also applies to any profiling based on this provision within the meaning of Art. 4(4) GDPR.
If you do object, we will cease processing your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or if the processing helps us to assert, exercise or defend against legal claims. Objection can be made informally and should if possible be sent to the address provided in the General Information section under 'Who is responsible for data processing and whom can I contact?'.

Use of cookies

When you visit our website, we use so-called cookies. These are small text files that are stored on your computer. Cookies help us to determine the frequency of use and the number of users of our Internet pages, as well as to make our offers as convenient and efficient as possible for you. This website uses Matomo, an open source software for statistical analysis of visitor access. The IP address is anonymised immediately after processing and before it is stored.
